The Right to Have What Rights? EU Citizenship’s Role Reconsidered

The conference will be dedicated to the legal analysis of the growing role of the concept of EU citizenship within the context of EU law. Now the border-line between EU law and national law potentially depends, to a great degree, on answering a question about EU citizenship rights. The Court has been timid, however, and up to now we only know that 'not to be made to leave the territory of the Union but not of your state of nationality' is the right which the Court is ready to use to activate EU law no matter what. It is clear that there can be many more rights out there, able to create similar effects. The idea of the conference is to start mapping EU citizenship rights to demonstrate how they will function in the context when they are able, directly or indirectly, to affect the scope of EU law. A number of further crucial questions arises, namely, how far can the federalizing importance of rights be stretched without undermining the coherence of the complex EU legal system.
